These Terms of Service (“Terms”) govern your use of services provided by MyHST Rebate, operating as 9837973 Canada Inc. (“MyHST Rebate,” “we,” “our,” or “us”). By using our website, submitting information, or engaging our services, you agree to these Terms. If you do not agree, please do not use our services.

 
1. Our Services

We assist clients with preparing and submitting applications for the GST/HST New Housing Rebate to the Canada Revenue Agency (“CRA”). Our services are limited to:

A) Reviewing eligibility for the GST/HST New Housing Rebate.
B) Advising on required documents and information.
C) Preparing and completing the rebate application forms.
D) Submitting the application to the CRA on your behalf.
E) We do not provide legal, tax, or financial advice beyond the scope of rebate preparation and submission.

 
2. Client Responsibilities

You agree to:

A) Provide complete, truthful, and accurate information and documents in a timely manner.
B) Notify us promptly of any changes to your circumstances that may affect your rebate application.
C) We are not responsible for delays, errors, or denials resulting from incomplete, inaccurate, or misleading information provided by you.

 
3. Fees and Payment

Our fees are listed on our website and are subject to change without notice.

Payment terms will be agreed upon before services begin and may include deposits, staged payments, or full payment upon completion, at our discretion. Fees are for the preparation and submission of the application only. They are not contingent on CRA approval, processing times, or rebate amounts.
 
4. No Guarantee of Outcome

We are not the CRA and have no control over their decisions. We cannot guarantee:

A) That your application will be approved.
B) The amount of any rebate.
C) CRA processing times or outcomes.
 
5. Limitation of Liability

To the fullest extent permitted by Ontario law:

A) Our total liability to you for any claim will not exceed the total amount of fees you paid to us.
B) We are not liable for indirect, incidental, or consequential losses of any kind.
 
6. Dispute Resolution

If a dispute arises, you agree to:

A) First attempt resolution through good-faith negotiation.
B) If unresolved, submit the dispute to binding arbitration in Ontario under the Arbitration Act, 1991 (Ontario).
C) Only if arbitration fails, you may pursue claims through the courts of Ontario.
 
7. Governing Law

These Terms are governed by and interpreted in accordance with the laws of Ontario and the federal laws of Canada. You agree to the exclusive jurisdiction of the courts in Ontario, subject to the arbitration provisions above.

 
8. Changes to These Terms

We may update these Terms at any time by posting revisions on our website. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
